1. Agreeing to these terms

You accept these terms by entering a name on this site, commenting a name on one of our videos to be added to a race, or opening a sign-in link we email you. If you don’t agree, don’t take part. The Privacy Policy explains what we do with your data and is part of these terms.

2. Who can play

You must be at least 13; if you are under 18 you need a parent or guardian’s permission. If the name you enter is a social media handle, it must be your own. We never ask for any password.

3. How the game works

Each race is a physics simulation of up to 200 marbles on a procedurally generated track, recorded and published as a video. Results are decided by the simulation; we don’t pick winners. We may change the track generator, grid size, scoring, pacing and features at any time, and we may skip or cancel races.

The draw. Because the grid is smaller than the pool of names, each race’s entrants are drawn by a published rule: anyone who pressed Race me (or whose commented name we added) since the previous race holds a ticket (a guaranteed slot, up to a share of the grid), and the remaining slots are a seeded, weighted ballot over everyone with a marble that favours whoever has waited longest and your marble’s Luck. We may tune these weights. We don’t guarantee that you will be drawn for any particular race.

Free to enter. Taking part never costs money and there is nothing to buy. No purchase or payment is necessary or possible, and nothing increases your chances other than taking part as described.

4. Points and upgrades

Points are a game score. They have no monetary value, cannot be bought, sold, transferred, exchanged or redeemed for anything outside the game, and are not property. We award them for race placement and once for claiming your marble, and you spend them on marble upgrades that affect the simulation. We may correct, reset or remove points and upgrades to fix bugs, undo abuse, or rebalance the game, and we will try to tell you when we do so broadly. Points are forfeited when your data is deleted or your participation ends.

Unless we publish separate official rules for a specific promotion, there are no prizes of monetary value. If we ever run one, its rules will govern it and will be free to enter.

5. Claiming a marble

Anyone can enter a name and look at its marble. To spend points or delete the marble you claim it: you give us an email address and open the sign-in link we send. The first email address attached to a name owns that marble, and every later sign-in link for the name goes to that same address. If someone claims a name that is yours (for example your real social media handle), message @marble.mania1 on Instagram and we can detach the address so you can claim it; we decide such disputes at our reasonable discretion.

6. Your name in the videos

To run the game we display the name you entered (or its initials) on your marble, in race videos we publish on TikTok, YouTube, Instagram and elsewhere, and on this site. You grant Tovuti LLC a worldwide, royalty-free licence to use it for that purpose, including in the published videos, for as long as you take part — and in videos already published, after you stop. You can end this by deleting your data; see Data deletion.

7. Fair play

You agree not to:

• use bots, scripts or multiple names to gain entries or points;
• impersonate another person or enter a handle you don’t control;
• enter names that are abusive, hateful or unlawful;
• attack, probe or overload this site.

We may remove points, void draws and results, block a name from future races, or delete a profile for breaking these rules.

8. Video platforms

Marble Mania is not sponsored, endorsed, administered by, or associated with TikTok, YouTube, Instagram or Meta. Where the videos are posted, and whether they stay up, is subject to those platforms’ own terms.

9. Availability, changes and ending the game

Marble Mania is provided as a free entertainment service, “as is” and “as available”, and may change, pause or shut down at any time. You can stop taking part at any time by deleting your data. We may end your participation if you break these terms or if we end the game.

10. No warranties; limits on liability

To the fullest extent the law allows: we make no promises that the game, races, points or this site will be uninterrupted, error-free or fair in any particular instance; you use them at your own risk; and Tovuti LLC and its people are not liable for any indirect, incidental, special or consequential loss, or for loss of points, placements, data or goodwill, arising from the game. Where liability can’t be excluded, it is limited to the amount you paid us, which is nothing. Nothing in these terms limits liability that can’t be limited by law, including for fraud or for death or personal injury caused by negligence, or your statutory consumer rights.

11. Governing law and disputes

These terms are governed by the laws of the United States and of the state in which Tovuti LLC is organised, without regard to conflict-of-law rules, except where your local consumer law gives you protections that can’t be overridden. If something goes wrong, message @marble.mania1 on Instagram first — most problems are a bug we can fix in a day.

12. Changes to these terms

We may update these terms; the effective date above tells you when. Material changes will be announced on the site. Taking part after a change means you accept it.
